These Terms & Conditions (Terms) govern your access to and use of EndlessCultivation.com (the Site) and your purchase of products from Endless Biotech (Endless, we, or us). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility & age. You must be at least 21 years old to use the Site or place an order. By entering the Site you confirm that you are 21 or older.
2. Hemp status & legal use. Our clones are sold as hemp as defined by the Agriculture Improvement Act of 2018 (the 2018 Farm Bill) — Cannabis sativa L. containing not more than 0.3% delta-9 THC by dry weight — and are intended for lawful cultivation. While federal law removed hemp from the Controlled Substances Act, state and local laws governing the sale, transport, and cultivation of hemp vary and continue to change. You represent and warrant that your purchase, possession, and cultivation comply with the laws of your jurisdiction. We may require eligibility information and may refuse or cancel any order at our discretion.
3. Products. Products are live plants. Photographs, strain data (such as THC ranges, flowering times, and lineage), and descriptions are provided in good faith but are estimates that describe the genetics' mature characteristics and may vary by plant, environment, and growing practices. We do not guarantee specific yields, potency, or results.
4. Pricing & payment. Prices are shown on the Site and may change at any time. The total for your order — including any shipping and applicable fees or taxes — is shown before you submit. We charge only for plants we ship; if we cannot fulfill an item, you are not charged for it.
5. Shipping. Live plants ship 1-day or 2-day service only, and only to states and localities where we are permitted to ship hemp. Risk of loss passes to you on delivery. You are responsible for providing an accurate, eligible shipping address and for receiving the plants promptly.
6. Live-arrival guarantee & claims. If a clone arrives dead, damaged, diseased, or carrying pests, file a guarantee claim with photos within 48 hours of delivery and we will replace or refund the affected plants, at our discretion. Claims made outside this window or without supporting photos may not be honored.
7. Returns. Because they are live, perishable plants, products cannot be returned. Your remedy for any qualifying issue is the guarantee claim process above.
8. Cancellations. You may request to cancel an order before it is packed. Once an order is packed and shipped, it cannot be cancelled.
9. Accounts. If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Provide accurate information and keep it current.
10. Disclaimer of warranties. Except for the live-arrival guarantee stated above, the products and the Site are provided 'as is', without warranties of any kind, express or implied, to the fullest extent permitted by law.
11. Limitation of liability. To the fullest extent permitted by law, Endless will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to a product will not exceed the amount you paid for that product.
12. Changes. We may update these Terms at any time; changes take effect when posted to the Site. Your continued use after changes are posted constitutes acceptance.
